Terms of Use for point8 Location/Navigation & Farm Welfare Monitoring App

1. Acceptance of Terms

By downloading, installing, or using the point8  mobile application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. About the App

The point8  app is a location calculation and welfare monitoring application designed for farm workers. The App was commissioned by North East, West Kerry Development (NEWKD), developed by Loc8 Code Ltd, and funded by the Irish Department of Agriculture, Food and the Marine.

3. Eligibility

You must be at least 16 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

4. License Grant

Subject to these Terms, Loc8 Code Ltd grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

5. User Responsibilities

5.1 Accurate Information
You agree to provide accurate, current, and complete information when using the App, including:
- Valid phone number for authentication
- Accurate emergency contact information
- Correct location permissions

5.2 Safety Disclaimer
IMPORTANT: This App is a supplementary safety tool and should not be relied upon as your sole safety measure.

- Do NOT rely solely on this App for your safety
- Always carry your phone with you during fieldwork
- call 112 directly in case of real emergencies
- The App does not replace professional emergency services
- Network connectivity issues may affect functionality
- GPS accuracy can vary based on environmental conditions

5.3 Proper Use
You agree to:
- Use the App only for lawful purposes
- Maintain the confidentiality of your account credentials
- Keep your emergency contact information up to date
- Ensure your device has adequate battery and network connectivity
- Review and respond to safety alerts promptly

5.4 Prohibited Activities
You must NOT:
- Reverse engineer, decompile, or disassemble the App
- Attempt to gain unauthorized access to the App or its systems
- Use the App to harass, stalk, or harm others
- Interfere with or disrupt the App's functionality
- Remove or alter any proprietary notices or labels
- Use the App for any illegal or unauthorized purpose

6. Location Services

6.1 Consent
By enabling monitoring features, you consent to the collection and processing of your real-time location data.

6.2 Accuracy
Location data accuracy depends on:
- GPS signal strength
- Environmental conditions (buildings, trees, weather)
- Device hardware capabilities
- Network connectivity

We make no guarantees regarding location accuracy.

6.3 Emergency Contacts
When you designate emergency contacts:
- They will receive location and alert information when monitoring is active
- You are responsible for obtaining their consent
- You can update or remove contacts at any time

7. Privacy & Data Protection

8. Third-Party Services

The App integrates with third-party services including:
- Google Maps Platform (mapping, geocoding, directions)
- Google Play Services (authentication, location)
-Twilio Communications API - Messaging via SMS & whatsapp
Your use of these services is subject to their respective terms of service and privacy policies.

9. Intellectual Property

9.1 Ownership
The App and all related content, features, and functionality are owned by Loc8 Code Ltd and protected by copyright, trademark, and other intellectual property laws.

9.2 Trademarks
- "Loc8 Code" and the Loc8 Code logo are trademarks of Loc8 Code Ltd
- "point8" is the product of Loc8 Code 
- "Wayi" is the trading name of Code Signs Ltd
- Google Maps is a trademark of Google LLC
- Twilio is Twilio Inc, USA

9.3 Fair Use
No part of this App may be reproduced, modified, or distributed without prior written permission, except as permitted under fair use or relevant copyright exceptions.

10. Disclaimers

10.1 No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or reliability of location data

10.2 Safety Limitations
WE DO NOT WARRANT THAT:
- The App will prevent accidents or injuries
- Emergency alerts will always be delivered successfully
- Location data will always be accurate
- The App will work in all network conditions
- All features will function during emergencies

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Loc8 Code Ltd, Code Signs Ltd, NEWKD, and the Irish Department of Agriculture, Food and the Marine SHALL NOT BE LIABLE FOR:
- Personal injury or death
- Property damage
- Lost profits or business interruption
- Loss of data
- Indirect, incidental, special, consequential, or punitive damages

ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Loc8 Code Ltd, Code Signs Ltd, NEWKD, and the Irish Department of Agriculture, Food and the Marine its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of applicable laws or regulations

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:
- Immediately upon posting in the App
- With notice provided through in-app notification
- Continued use constitutes acceptance of modified Terms

14. Termination

14.1 By You
You may stop using the App at any time and delete it from your device.

14.2 By Us
We may terminate or suspend your access to the App:
- For violation of these Terms
- For any reason with or without notice
- If required by law or legal process

14.3 Effect of Termination
Upon termination:
- Your license to use the App ends immediately
- You must delete the App from all devices
- Provisions regarding limitations of liability, indemnification, and disputes survive termination

15. Governing Law

These Terms are governed by the laws of Ireland, without regard to conflict of law provisions.

Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the Irish courts.

16. Dispute Resolution

Before filing any legal action, you agree to attempt to resolve disputes through:
1. Direct contact with Loc8 Code Ltd
2. Good faith negotiation
3. Mediation if negotiation fails

17. Severability

If any provision of these Terms is found to be invalid or unenforceable:
- That provision shall be modified to the minimum extent necessary
- All other provisions remain in full force and effect

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Loc8 Code Ltd regarding the App.

19. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
